Our commitments to you

This Carrier Bill of Rights (the "Bill of Rights") states the commitments that FleetPath Technologies, Inc. ("FleetPath," "we," "us") makes to the commercial motor carriers, owner-operators, and fleets that use the FleetPath platform (each, a "Carrier" or "Customer"). It is incorporated by reference into Section 12 of the FleetPath Terms of Service and is to be read together with the Terms of Service, the Privacy Policy, and the Data Processing Addendum.

Where a commitment in this Bill of Rights is more protective of the Carrier than a corresponding provision of the Terms of Service, this Bill of Rights controls as to that commitment. In all other respects, the executed agreement between the parties governs.

Each right below is subject to a narrow set of exceptions, where FleetPath must act to prevent fraud, to comply with law or valid legal process, or to protect the safety or integrity of the platform or its users. Those exceptions are stated within the rights they affect and are not open-ended.

1. Data portability: you can take your operational data with you

You may export your operational data in a machine-readable format. Today, FleetPath provides a full-account export of your records and documents as well as machine-readable, per-module exports, for example the settlement and tax-summary export delivered as a downloadable CSV file, and generates statements, invoices, and compliance and claims records that you can download while your account is active. On account closure, FleetPath preserves a thirty (30) day window during which your account remains accessible, so that you can export your data before the retention-aware deletion process begins.

2. Transparency into automated decisions that affect you

When FleetPath software proposes or takes an action that affects your operation, you are entitled to see the basis for it, in plain terms.

Automated dispatch proposals. Every load recommendation the Operator (also surfaced as the Dispatch Copilot) presents can be opened to a deterministic, reproducible explanation of the true factors behind it: expected margin, empty (deadhead) miles, hours-of-service fit, the broker's authority and insurance status and any risk flags, and the compound suitability score together with the weights applied, plus any counter-offer rationale, the sourcing envelope you configured, and the audit trail of what was proposed, approved, and acted on. This explanation is built from the actual decision factors, not a narrative approximation, and involves no generative model.

Authority and audit. No automated action commits you beyond the authority you configure. Every proposal, approval, and committed action is written to an auditable record that identifies whether a person or a configured Operator seat acted, who approved it, and against which limit. The authority resolver fails to the most restrictive, suggest-only setting on error, so a fault can never widen what the software is permitted to do.

Broker and carrier scorecards. Where a broker's view of your performance is derived from your delivered-load record, loads completed, on-time percentage, proof-of-delivery turnaround, and most recent load, you can view that scorecard yourself. It is computed from your own operating facts, not from an opaque rating.

For any other materially adverse automated decision, you may request the basis for it, and we will furnish it.

3. Non-discrimination in access to platform features

FleetPath does not condition access to platform features on a Carrier's identity, size, or affiliation. Feature availability is governed by your subscription and the role-based permissions you configure, not by who you are. Load ranking is performed by multi-objective compound suitability scoring against hard compliance gates (for example, hours-of-service and equipment fit); the factors and their weights are disclosed to you (see Right 2), and you set your own sourcing envelope.

4. Notice and a path to be heard before suspension

Before FleetPath restricts or suspends your access to the platform in a non-fraud dispute, you are entitled to notice of the reason and a no-cost internal review before the restriction takes effect, where practicable. This does not apply where immediate action is required to stop fraud, to comply with law or valid legal process, or to protect the safety or integrity of the platform or other users, in which case you are entitled to notice and review promptly afterward. Where your own account is scheduled for deletion, you may cancel that deletion at any time during the thirty (30) day grace window.

5. Privacy protections built into how your data is shared

FleetPath is built so that sharing your location and load information with outside parties never exposes more than you intend. The following are shipped, enforced defaults, not aspirations:

Delayed location for outside stakeholders. Position shared with a broker, shipper, or receiver is delayed, by default ten (10) minutes for brokers, shippers, and receivers, and fifteen (15) minutes on fully public links. A hard five (5) minute floor is enforced at the moment the data is read, so no outside stakeholder ever sees a position fresher than five minutes old, and a misconfiguration or a stored value of zero can never produce a live dot. This exists to protect your loads and drivers from poaching and load-theft risk.

Per-field privacy controls on shared links. Every shared tracking link honors the per-field visibility controls you set: driver name, rate, weight, commodity, exact address (city and state only by default), and which document types, if any, are shown.

Double-blind carrier identity. On broker-posted loads, the assigned hauling carrier's contact identity is withheld from shippers and receivers by default and is disclosed only when the broker explicitly opts in. This behavior is enforced in code and covered by an automated invariant test.

You may tighten these controls further at any time; you may not set the location delay below the five-minute floor, which exists for your protection.

6. Your data is yours

As between you and FleetPath, you own your operational data, including your location, ELD, and fuel data. FleetPath processes it only to provide the service under the Terms of Service, the Privacy Policy, and the Data Processing Addendum. We do not sell personal information, and we do not use your operational data to train third-party general-purpose models. If you opt in to any aggregated industry-benchmark feature, it uses only de-identified and aggregated data, and FleetPath makes no attempt to re-identify you.

7. How we honor these rights, and how to invoke them

Each right above maps to a concrete surface or contact.

Export your data
In-app: a full-account export of your records and documents, plus per-module exports (for example the settlement and tax-summary CSV export). For a formal portability request, contact us at the address below.
See the basis for an automated decision
Open the explanation on any Operator dispatch proposal, view your broker and carrier scorecards, and review the audit and delegation trail. For any other materially adverse automated decision, request the basis at the address below.
Access, correct, or delete your data
Use the rights process described in the Privacy Policy. Account deletion is self-serve in Settings and carries a 30-day undo window.
Control what outside parties can see
Carrier or broker settings, tracking visibility: per-field toggles and the location-delay setting, never below the five-minute floor.

We may update this Bill of Rights. If a change is material, we will update the date above and, where required, notify account administrators, consistent with Section 14 of the Terms of Service. We will not amend this Bill of Rights to reduce a Carrier-protective commitment without notice.
